The Notartermin is where ownership commitments become legally binding. Under German law (§311b BGB), any contract concerning real estate requires mandatory notarial authentication (notarielle Beurkundung). The notary is a neutral public official, not your advocate: they ensure legality, not that you made a wise financial deal.

Phase 1: The 14-Day Review Rule. Under §17 Abs. 2a BeurkG, if you buy as a consumer from an entrepreneur (or broker-arranged institutional seller), the notary must deliver the exact contract draft at least 14 full days before the appointment. Do not waive this period. Use these two weeks to read every line, have your lender review the draft, and cross-check the land charge authorization.

Phase 2: Critical Contract Clauses Checklist

  • Finanzierungsvollmacht (Belastungsvollmacht): Crucial! Permits you to register the bank's Grundschuld before you become the registered owner, enabling your bank to pay out the loan directly to the seller upon due date.
  • Kaufpreisfälligkeitsvoraussetzungen: Clear preconditions before any euro is paid: (1) Auflassungsvormerkung registered for you in Section II of the Grundbuch; (2) all seller deletion approvals (Löschungsbewilligungen) secured by the notary; (3) statutory waiver of municipal pre-emption rights (Vorkaufsrechtsverzicht §24 BauGB); (4) WEG administrator approval (Verwalterzustimmung §12 WEG) in notarized form.
  • Haftungsausschluss für Sachmängel: Standard resale contracts exclude liability for physical defects ("gekauft wie gesehen"). Seller only liable for fraudulent concealment (arglistige Täuschung §444 BGB).
  • Zwangsvollstreckungsunterwerfung: Both buyer and seller submit to immediate execution (§800 ZPO) if payment or transfer defaults.

Phase 3: The Signing Appointment The notary reads the complete contract verbatim (Vorlesen des Kaufvertrags). Interrupt immediately if any number, name, or condition is unclear or differs from your draft! Once signed by all parties and the notary, the contract is legally binding.

Phase 4: Post-Appointment Steps

  1. Notary files for your Auflassungsvormerkung in the Grundbuch.
  2. Tax office issues Grunderwerbsteuer assessment (pay within 1 month to receive Unbedenklichkeitsbescheinigung).
  3. Notary sends formal Fälligkeitsmitteilung when all conditions are fulfilled (typically 4–8 weeks after signing). You instruct bank payout.
