Drafting Tenancy Agreements Legally: Deposit, Operating Costs & Repairs

In German residential tenancy law, standard contract terms are scrutinized as General Terms and Conditions (AGB-Recht §§305 ff. BGB). Clauses that unreasonably disadvantage the tenant are legally null and void (unwirksam), reverting automatically to statutory default rules that heavily favor the tenant.
1. The Rent Deposit (Kaution §551 BGB):
- Maximum three net cold months (Nettokaltmieten). Any clause demanding more is legally void.
- The tenant has a statutory right to pay in three equal monthly instalments.
- The landlord must deposit the funds in an insolvency-proof bank account, separated from personal assets (Treuhandkonto), earning standard savings interest.
2. Operating Costs (Betriebskosten): If your contract states "Miete inklusive Nebenkosten" or fails to explicitly reference the Betriebskostenverordnung (BetrKV), all operating costs are legally included in the rent and cannot be billed or increased! The contract must explicitly state that the tenant bears operating costs pursuant to §2 BetrKV and pays monthly advance prepayments (Vorauszahlungen).
3. Schönheitsreparaturen (Cosmetic Repairs): Rigid repair schedules (e.g. "kitchen must be painted every 3 years") or clauses demanding the flat be returned newly renovated regardless of condition upon handover are invalid under established BGH case law (VIII ZR 185/14). If the clause is void, the landlord remains responsible for all painting and decorating at their own expense!
